Some of you make it sound like this is a cheap way to get out of trouble, the problem is, it isnt. to me, its a pretty petty "crime". although its a repeat offense and against league policy, sure, hes most likely deserving of punishment, but the whole point of lawyers and the judicial system is to find a technicality, a loophole if you will, and get out of trouble. or, in some cases, prove your innocence...or at the least, instill doubt in the juror or judges mind.
if i was in his shoes, i too would be looking at every way to get out of what hes facing. and if theres a means to that end, he has EVERY right to pursue that and in the spirit of the judicial system he should, should he not? should he sit back and take his lumps knowing he could have faced it?
apples to oranges here but if someone is caught for a DUI and the arresting officer makes a mistake opening up a loophole for you to get the charge dropped or lessened, would you not pursue it? Youd just sit back and say, naw, im guilty, throw the book at me...knowing you have a way out? i mean, when faced with a pretty serious outcome, you are going to do everything in your power to lessen the penalty/fine/sentence.
Good Luck BB.
