You know, maybe Marvin is right. Aldon got his weapons, DUI and possession charges in the Bay area. A place where one can bash another with a beer bottle and not be charged with anything as long as the victim is a lesser player.

They needed Brooks on the field, the DA knows this. Why would the DA reduce the chances of the Niners quest for 6 by prosecuting Smith and sabotaging the defense? Heh.... the DA has his luxury suite in the new stadium free of charge just for the Brooks exoneration. I wonder what else the Niners can offer.

A riverboat casino venture?

*chuckle* Nice one.

Wow. The BS is getting deep in here.

So sick of the "he's getting off because he's an athlete" thing when in reality its "I'm mad he's getting off because he plays for a team I don't like and want really bad things to happen to them".

Aldon is a moron. Absolute wrong place to make that joke. No defending that. In the end tho, it was a joke and the punishment should fit the crime.

How is that BS? Don't put words in my mouth. I feel the same about everyone; the team or the player has nothing to do with it.

It sure as hell isn't a joke and only a damn homer would say that. Anyone regular civilian would go through hell for the stupid crap he's done, but here's Smith again, getting a slap on the wrist.

Misunderstanding me. The situation is no joke. It was an should be treated seriously.

His COMMENT was a joke. Moronic for sure, but I don't think anyone should face a felony charge for making a really bad joke, athlete or not.

And yet dozens of people face those felony charges for making similar jokes.

Sigh.

If you guys REALLY think that him being a celebrity is the reason its not being looked at as a felony....

....I just don't know what to say. Believe what you want to believe. If anything, they wouldn't want to be seen that way and would be MORE likely to charge him. Not less.

....I just don't know what to say. Believe what you want to believe. If anything, they would want to be perceived as being tough on celebs but the evidence is clear. Another slap on the wrist is LESS than what you and I would get.

Evidence is clear? Really?

Show me evidence of EXACTLY what was said, how it was said and the circumstances surrounding it and then show me a non-celebrity at LAX who got different treatment for the same behavior.

If you can find that, then I'll buy your argument. Until then...

I want to be clear here though. I'm not defending his actions. Idiotic. Stupid. Not funny.

Felony? Doubt it. Felonies carry more than a YEAR in prison. You seriously think the DA should put a guy in prison for over a year because he made bad joke?

Athlete, Actor, Politician, Joe Schmoe.....that makes no sense to me.

Or you could just hang out at Webzone more and here a lot less. Just a suggestion.

Why would I do that?

Oops. I'll change the wording. I meant him of course, not you.

Would it help if I said it's been a long week?

Dude all you do is defend. It's like you feel it's your duty to stand up against any and all things against 49ers. But hey, do you!

LOL. OK. If you say so. No worries.

I just don't think a guy should serve multiple years in prison for making a joke. Call me crazy. I'd think that regardless of who it was.

I don't think so either but plenty of everyday citizens have for making jokes

I think the best thing that could happen to Aldon would be for him to settle down with some nice girl and have a normal relationship.

Lindsay Lohan would be just about right.

If that is not his type, perhaps Justin Bieber would be.

This is hilarious, I never expected them to press felony charges for his ignorance but I do expect his actions will impact his other pending issues and that is really good enough.

Marvin is not wrong in this context. They are not going to do much about the airport incident in part because he will get hammered enough when the other charges come down and the airport will factor into that decision.

Well marvin if you think his celeb status isn't influencing anything please conduct a field test for us and go get arrested on suspicion of DUI and marijuana possession. Get charged with three felony weapons counts while holding a party held at your house. And I believe in 2012 he had another DUI. I'm pretty sure with all of that in a 2yr time period we wouldn't be hearing from you for a little bit.

That's entirely possible.

I'm wondering though if they will charge him in LA before his court appearance on the 29th (next week). I'm sure his lawyer will argue not to include that incident as we may not have even been charged at that point. If he IS charged, then it will probably tie into whatever plea he ends up taking.

My problem is this if it was just one incident Ok I can see a brake. But this has been a history if stupid immature actions that need to be addressed. It's actually to me to the point of let's see what I can get away with. It's transparent that he does not care. Sorry Marvin I just don't agree with you.
Yes the punishment must fit the crime. And it will hopefully.

1) First DUI has been plead down already. Case Closed.
2) He has been charged with a felony for the Guns. What else at this point could have happened? He hasn't yet been tried or had his day in court.
3) Same with the DUI.

I doubt he ends up behind bars because the Gun charge is hard to prove, but NOBODY would be behind bars right now because the legal system is SLOW. You don't go to jail when you have been charged but not yet convicted.

No worries. I'm used to people here not agreeing with me. :D

As I said before. The guy is a first class moron. I can only hope he grows up and matures. I'm sorry, but the airport thing, while moronic and stupid, doesn't warrant over a year in prison for me. The DUIs? That's much more troubling...especially since he was popped once and did it again. Thank God he didn't hurt anyone.

The Gun Charge? Again...stupid. As I understand it, its a tough thing to prove from legal perspective. I honestly don't know where I stand on it because if he were a player on most other teams they wouldn't even be illegal. Still...it is illegal in CA and he did break the law. Not sure what I think should happen in that case.

I agree on his pattern of behavior. I just hope something here knocks some sense into him.
