It's not that cut and dry. Its more of a sliding scale. Just because your legally drunk does not automatically make you incapable of giving consent. Of course, Florida law controls in this situation.

In the eyes of the law it does. If they had sex, and she was drunk, and came out and called it rape, in the eyes of the law, she can not give consent, regardless if she did or not.

I'm not saying it's fair, I'm saying that's how it's interpreted in court.

My guess is no just because its all hearsay...

...but I'd also guess that they are about to get "random" checks much more often.

All of this thread is moot speculation.

She woke up in the hospital the next morning. It is the hospital report that will tell all. I would love to know why someone would feel the need to take someone to the hospital and then not stick around. Sounds like something junkies would do to an OD'd buddy. If someone had stuck around maybe it wouldn't have been such a mystery for her. Why not call an ambulance? The story reeks of deception and incompleteness.

It is all suspicious. The marijuana consumption is really the only viable trouble they are facing at this point.

nudity doesnt equal consent. girl gets naked, your fooling around, and doesnt wanna have sex or passes out, if you continue, thats rape guys. unless its your wife or SO, and even then its shady.

That's odd to me as well...but then again maybe whomever dropped her off didn't know she wouldn't remember them taking her there. Who knows.

This will go the same place every other case does. He'll never be proven guilty, will stay on the team, and despite the gripes from fans of every division opponent for years on end that he's a scumbag unworthy of the NFL, will continue to show up in the playoffs every year and demand to be defeated on the field.

To judge someone guilty of a crime because you dislike a player on an opposing team is fairly despicable.

This is not an alleged sexual assault, according to the police report, and we should not pretend it to be one until we have more facts, regardless of what TMZ says.

Correct.

The police report came out with no mention of anyone having sex. The Miami PD has stated that at this point they are not investigating a crime.

TMZ is just covering their a$$es right now because they stated he was being investigated for Sexual Assault.

It is non-story to me, until it is a true story. So far, all I have read is that they were partying, a girl got too messed up and was brought to get medical assistance.

The incident was initially reported online by TMZ as a sexual assault, but Pimental said the celebrity gossip news site "took the report out of context."

That tells me its not even an investigation. Am I reading that wrong?

Yes, it should be stated that Kaepernick does come off looking like a huge douchebag, although not an alleged rapist. Getting a girl drunk off her ass, pressuring her into taking a bong hit, and then undressing the barely conscious girl is not very gentlemanly behavior. It may be common behavior, but it's also common douchebaggery.

If he does get falsely accused of sexual assault at some point, he will be at least in part to blame for being so reckless.
