She had to have had a toxicology report done. So if she was roofied or anything like that, the cops will know soon enough. If she wasn't, and the rape kit showed no issues then nothing more will come of it.

This sounds like something Kap will beat, even if they find his DNA. To much reasonable doubt.

The big issue for me is the fact the these 3 guys were in that situation at all.
Yes they are young and rich but they should be protecting what got them rich, not putting it in jeopardy.

It's the same ole song n dance we've heard before. Some guys can handle it and some guys can't.

There is not even evidence in the report that they even had sex that night . . . she drank too much and probably felt disrespected by the two guys who walked in on her while she was naked, which is very similar to the Jameis Winston situation.

If they find physical evidence of sexual assault, a date rape drug in her system, or DNA from one of three, then that changes things. But as it stands now, there is no probable cause for sexual assault.

Yes. A blackout is not the same thing as being unconscious. There are many cases of girls having sex in clubs in front of witnesses while in a blackout - but fully conscious and participating consentually - then coming out of the blackout and wrongly perceving it as being raped while passed out. She files rape charges, goes to court, then is humiliated by a dozen witnesses who describe her consentually having sex with a guy in a bar.

Alleged rapists don't tend to bring their victim to the hospital, where she could be immediately tested and interviewed about what happened.

This sounds more like a confused girl who doesn't know WTF happened to her after she crossfaded with alcohol and marijuana.

It's not that cut and dry. Its more of a sliding scale. Just because your legally drunk does not automatically make you incapable of giving consent. Of course, Florida law controls in this situation.

Per the police report, she never said she was raped. In fact, she explicitly said she doesn't recall having sex.

The facts are a little vague with her getting undressed and then the other guys walking in on her. This is probably standard procedure at that hospital to ensure that she was not sexual assaulted while she unconscious.

All in all, this is the problem with the media jumping to conclusions by calling it a sexual assault, when that has not even been alleged yet.
