Don't read the contract....

So what are your thoughts - how should an organization handle this? Sure on one hand you have the contract but in the other hand if the guy is in shape and a starter don't you want to keep him happy?

Hahaha, seriously? Pray for you? Because you're a millionaire already and lost out on another $2 million? If I pray for you, it will be for you to be a little bit smarter.

Give him some, if not all the dough. He was the Niners most reliable corner last year and played big in the playoffs. Busted his *** during the offseason and missed out on cash because of a formality. I think he deserves it, but I understand it's a business at the same time. That 2 mil saved this year would work with an Iupati extension if Brown doesn't get it.

I am sure he will play well all year getting paid peanuts. Getting screwed out of 2 millions dollars would not leave a bad taste in a mans mouth. If the 9ers don't get this fix there secondary problems are going to get even worst.

Seahawks just gave Browner a raise because it is the right thing to do. They can't give raises to Sherman or RW or I am sure they would. I think the right thing to do is give him $1million straight up and the other million in season bonuses. Give him nothing and send a message to everyone....

And I agree - the pray for me is like a joke. But with that said this is 25% of his contract. $2 million is a huge amount for this guy no matter how well off he is right now. No he isn't starving and if he thought about it he would probably not use those words but this is a big deal.

It doesn't go back on the cap so it won't help to resign anyone. It is considered a penalty. I agree they should come up with some way to compensate him but first he should be suing his agent. No judge in the world would deny it is the agents responsibility to know and translate these type of details but it also falls back on the organization because they should have informed Brown that he would lose the money if he doesn't attend.

As for just giving him the money you would be setting a bad precedent for future issues that will undoubtedly arise. If they are smart they will create an incentive that benefits both him and the team. and I would be surprised if they don't. It definitely could become a distraction and could also effect future signings. Especially with Brown and if I am correct he is in the last year of his deal this year so maybe the smart thing would be to resign him now and bump his contract to reflect regaining the money. That is if they have the cap space right now to resign him.

Tough break. Wish I could say I hope it doesn't disrupt things but I would be lying. :D

^ it will be interesting to see his effort on the field if SF does nothing to appease him. Their secondary already has holes in it.

Hopefully it affects his play. I hope Tate reminds him of it. Seems like good fodder for trash talk. "Hey bro, can I borrow 2 mil?"

RichNhanson - can you or someone else elaborate on why this is not going back to the cap? They didn't pay the bonus? If that is correct they can't pay him as it wi hurt the cap. My assumption was it goes back to the cap so they should make a deal. The precedent they series if you do everything "right" then we take care off you..... Not a bad precedent to set

Sando shows the $2 million going back to the 9ers cap. Not sure what to think. Yeah, his agent could have reminded him of the clause in his contract, but if I know I would get triple the money I made the previous year of my contract, that date would have been etched in my mind. The contract was signed a few years ago but his agent probably assumed his client was aware of the stipulations of the contract. I doubt it was hidden in the contract.

Not sure what the 9ers should do. Having him participate in the offseason stuff was important to them, or they wouldn't have put it in the contract. Or they assumed he was going to be there anyway and this was easy money. I would probably accommodate him but at a smaller amount, just to let him know that all was done in good faith and there should be some type of accountability.

Its counterproductive to dog it on the field when you're looking for a new contract. Brown needs to continue to showcase himself. If he plays like he has been he will be making well more than 2 mil.

Its his own fault too. Guys need to know their damn contract.

The agent screwed up, unless he can clearly show he explained the requirement to Brown. So as to the dispute between Brown and his agent, documentation will be key.

As for whether the Niners can "fix" this, I don't think they have an obligation to do so. IF they decide to, then I am sure it will be in the form of an extension. But I also can't help but think that other team owners will be paying attention to this. Many of them will probably not like any precedent of a team just paying a player because he didn't know what was in his own contract.

The agent may have screwed up by not serving his client right but unless they have an agreement that the agent is responsible for making sure his client maximizes the contract there is no way he can sue him

1) Prove that the agent didn't tell Brown is hard
2) Brown signed the contract / is responsible for reading it

49ers does NOT have an obligation to fix it. Many teams would fix it just because it is the right thing to do. Seahawks didn't have to give Browner a raise - when is the last time someone got a pure raise???? They felt it was the right thing to do so they did it. Maybe you don't give him the full $2 million but if my company screwed me on a big fat bonus because of a small error that in the end didn't impact my work at all then I would simply leave shortly after. I would have no reason to work hard for them even if the technicality was due to my fault. This is how most people would feel. If my company fixed / mostly fixed the problem and worked with me then I would maybe come out even more committed to the organization knowing they do the right thing

I expect Harbough to tell him to pound sand

Why would it go back to the cap?

It isn't a bonus. It is 2 million in SALARY paid out over the year IF he took part in workouts. He did not. That portion of his salary is gone. Why would there be a charge on the cap?

...or am I completely misunderstanding.

^ You are misunderstanding. He meant it goes back to the amount that you can spend under the salary cap. It goes back as unspent money that you can now spend elsewhere

Which is why I am under the opinion that if the guy is in shape and ready to go you give it to him in some other form this year since the outcome for the team is status quo

OK. I was reading that in reverse.

Yes, they have an additional 2 Mil under the cap but my guess is that they'll probably end up extending him and as a part of that contract recover some of what he lost.

His new agent should look to getting an extension if that was something the team wanted to do in the first place, thereby tearing up this year's contract and recouping the 2 Mil lost. Next time I would bet Brown will be closely monitoring any and all bonus payout plans.

Not that you guys care, but I found the info at www.ninercaphell.com since some of you were wondering if it would count against the cap. A Niner fan and a frequent poster on the webzone keeps track of everything salary cap related for the 49ers and inputs that data onto his website. Shows all dead money, salaries, bonuses etc. for Niners.

As someone mentioned after my post, I think it would be a good idea to give him the opportunity to earn some of that money back through incentives rather than just giving it to him. That I could agree with.
